What Is the Equity Release Council and Why Do Its Standards Matter?

The Equity Release Council is the UK trade body for equity release and later-life lending. It is not the statutory regulator. Its members voluntarily commit to additional standards and product safeguards alongside the FCA rules that apply to regulated firms.

The quick answer
The Equity Release Council is a voluntary UK trade body representing firms in equity release and later-life lending.

It does not regulate the financial-services industry and should not be described as a government watchdog. The Financial Conduct Authority regulates authorised mortgage advisers and lenders. Council members agree to follow additional standards covering advice, legal safeguards and product design. Plans that fully meet the Council’s Product Standards include secure tenure, fixed or capped interest rates, the ability to move to an acceptable property, a no negative equity guarantee and penalty-free repayment rights within lender criteria.

Plain-English guide

How Council standards fit alongside FCA regulation

There are two different layers of protection to understand. FCA rules apply to regulated mortgage firms and include requirements around advice, suitability, disclosure and conduct.

The Equity Release Council adds voluntary industry standards for its members. These standards are not Acts of Parliament, but member firms commit to follow them as a condition of membership.

The Council logo can therefore be a useful sign that additional safeguards apply. It does not mean every plan is suitable, that the property will always be accepted or that no conditions exist.

Important: The Council is a trade body, not the regulator. Check that the adviser and lender are appropriately authorised by the FCA as well as whether they are Council members.

What product safeguards apply?

A plan meeting the Council’s Product Standards includes a no negative equity guarantee, secure tenure while the property remains the main residence and contract terms are followed, and a fixed interest rate or a capped variable rate for life.

It also includes a right to move the plan to another acceptable property and a facility for penalty-free repayments within lender criteria.

What does secure tenure mean?

It means the homeowner has the right to remain in the property for life or until moving permanently into long-term care, provided the home remains the main residence and the contractual obligations are met.

It should not be presented as an unconditional right regardless of serious contract breaches.

How does the no negative equity guarantee work?

When the property is sold following a qualifying end to the plan, the borrower or estate will not have to repay more than the net sale proceeds, provided the product conditions are met.

The guarantee prevents personal negative-equity debt. It does not guarantee that an inheritance will remain or that the balance cannot consume all available equity.

Does the right to move guarantee every new property?

No. The mortgage can be transferred only where the new property is acceptable to the provider as continuing security.

A lower-value property may require a partial repayment, and an unsuitable property can be declined. Downsizing protection may offer another route where included and its conditions are met.

Older homeowners reviewing equity release consumer protections and product standards.
Council-standard plans include defined safeguards, but suitability and contractual conditions still need to be understood.
Three common situations

Three ways the standards matter

The safeguards become especially important when house prices, family circumstances or housing plans change.

01

The eventual balance exceeds the sale proceeds

The no negative equity guarantee prevents the estate from having to pay the shortfall personally, subject to the plan conditions.

02

The homeowner wants to move

The right to port applies where the replacement property meets the provider’s criteria. A partial repayment may be required.

03

The borrower wants to make repayments

New Council-standard plans include a facility for penalty-free repayments within the lender’s permitted limits and rules.

Balanced decision

Protections matter, but suitability still comes first.

A protected product can still be expensive or inappropriate if the borrowing amount, purpose, alternatives and future plans have not been assessed properly.

Checks worth making

  • Is the adviser authorised by the FCA?
  • Is the lender authorised and a Council member?
  • Does the exact product meet the Product Standards?
  • What conditions apply to tenure and moving?
  • How do repayment allowances and charges work?

What this means in practice

  • The FCA is the statutory financial regulator.
  • The Council is a voluntary trade body.
  • Members commit to additional standards.
  • Product safeguards remain subject to contract terms.
  • Advice and independent legal review are still essential.
Frequently asked questions

Your questions answered

Is the Equity Release Council part of the government?

No. It is an industry trade body whose members voluntarily commit to its standards.

Does the Council regulate advisers?

No. The FCA regulates authorised financial-services firms. The Council sets and monitors standards for its own members.

Does the Council guarantee I can stay in my home?

Council-standard products provide secure tenure for life or until permanent long-term care, provided the property remains your main residence and you comply with the contract.

Does the logo mean the plan is risk-free?

No. Interest can compound, inheritance can be reduced, benefits can be affected and moving options can be restricted. The logo indicates defined safeguards, not an absence of risk.
